By registering, accessing, or utilizing the services provided on MployD.in, both Candidates (Job Seekers) and Recruiters (Employers, Talent Acquisition Teams, and Hiring Partners) agree to abide by these Terms & Conditions.
1. Compliance & Indian Statutory Alignment
MployD operates in full compliance with the laws of the Republic of India. These Terms & Conditions are executed in alignment with the following statutory frameworks:
- The Rights of Persons with Disabilities Act, 2016 & Equal Opportunity Mandates: Strictly enforcing non-discrimination during profile discovery, proposal evaluation, and interviewing based on race, caste, religion, gender, sexual orientation, disability, or age.
- The Information Technology Act, 2000 & IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021: MployD operates as a digital intermediary. Users agree not to post false, defamatory, misleading, or illegal content. All personal data is processed securely under standard encryption and privacy mandates.
- The Digital Personal Data Protection (DPDP) Act, 2023: Candidate personal identifiable information (PII) is processed strictly on an explicit consent basis. Candidate profiles remain anonymous or semi-anonymous during the Initial Discovery Phase, and explicit consent is required before contact details are unmasked to Recruiters. Details are shared with a verified recruiter upon mutual match and soft-lock activation.
- The Contract Act, 1872: Proposals, expressions of interest, and compensation benchmarks submitted on MployD constitute non-binding expressions of commercial intent and do not form a legally binding contract of employment until a formal written Offer Letter is issued and accepted post-interview.
2. Terms & Conditions for Candidates
2.1 Profile Veracity & Pre-Vetting
- Accuracy of Information: Candidates must provide truthful and accurate information regarding education, work experience, past CTC/compensation, skill sets, and notice periods.
- Background Verification: Candidates consent to preliminary verification checks conducted by MployD or its authorized verification partners. Providing false credentials, fabricated experience certificates, or misleading claims will lead to immediate account termination.
2.2 Agreement for Sharing of Data
- You agree to the sharing of personal data including your name, email address and phone number. These remain masked during the discovery phase and are released to a recruiter only on the terms set out in 2.5 below.
2.3 The 28-Day Hiring Cycle Participation
- Phase 1 — Talent Discovery (7 Days): Candidates agree to allow verified recruiters to review their skills/experience and submit non-binding Proposals / Compensation Packages.
- Phase 2 — Interviewing & Selection (21 Days): Once a candidate accepts a recruiter's Proposal, they commit to participating in scheduled interview rounds within the stipulated 21-day window.
- Response Integrity: Candidates agree to maintain active communication during the 21-day interview cycle. Unreasonable drop-outs, failure to attend agreed interview slots without prior notice, or non-responsiveness may result in platform suspension.
2.4 Non-Binding Nature of Proposals
- Candidates acknowledge that Proposals or Expressions of Interest received during the 7-day discovery phase reflect market valuations and preliminary intent, not a final, legally binding employment contract. Final employment terms remain subject to performance in the 21-day interview stage.
2.5 Privacy & Anonymity
- Candidate contact information (e.g., phone number, email address, current employer name) remains protected during initial discovery and is unmasked to a recruiter only upon mutual match or explicit candidate acceptance.
3. Terms & Conditions for Recruiters & Employers
3.1 Platform Authorization & Account Security
- Recruiters must register using a verified corporate email domain and valid business identification (e.g., GSTIN, CIN, or corporate registration details).
- Recruiters agree not to market non-existent roles, collect candidate data for third-party databases, or solicit services outside the MployD ecosystem.
3.2 Upfront Proposals & Compensation Integrity
- No "Bidding" or "Auctioning" Mechanics: All proposals extended to candidates must represent genuine, competitive compensation structures (Base Offer Limits / Package Proposals) made in good faith.
- Upfront Alignment: Recruiters agree that final employment offers extended post-interview will not undercut the benchmark range proposed during the 7-day discovery phase, provided the candidate's verified skills match their profile disclosures.
3.3 Adherence to the 28-Day Hiring Timeline
- Phase 1 Commitment (7 Days): Proposals must be submitted within the active discovery window.
- Phase 2 Commitment (21 Days): Recruiters agree to conduct technical evaluations, assessments, and management interviews strictly within the 21-day interview sprint.
- Decision Deadline (14 Days): Recruiters are obligated to mark candidate status (Proceed / Regret) within 14 days of a Soft-Lock being activated. The 21-day window is how long the selection process may take; this is how long a candidate may be left without an answer, and the two are not the same obligation.
- Anti-Ghosting Policy: Prompt feedback is mandatory. A status left unmarked at the 14-day deadline is treated as ghosting, counts against the Recruiter Performance Index, and repeated occurrences may flag the account for review. No fee or credit debit attaches to it: the consequence is to the account's standing, not to its balance.
3.4 Flat Commercial Fee & Payment Terms
- Package Selection & Upfront Fee: MployD operates on a credit-based marketplace model. Recruiters must purchase a hiring package upfront prior to initiating talent discovery or extending proposals. Each package grants a dedicated balance of Platform Credits.
- Credit Validity Period: The validity period of Platform Credits differs and is uniquely defined for each package tier, as set out below and in the package order form selected on purchase. Unused credits expire at the end of that period.

- MployD reserves the right to change the validity period at any time. Existing contracts will not be affected.

Credit Consumption & Workflow Reconciliation:
Credits are managed, deducted, and reconciled based on candidate progression through the hiring cycle:
- Soft-Lock Activation (No Charge): No credit is deducted when a Soft-Lock is activated on a candidate profile. Activation grants the Recruiter full access to the candidate's Personally Identifiable Information (PII) and initiates the 21-Day Selection & Interview Window.
- Successful Shortlist / Final Selection (1.0 Credit Consumed): One (1.0) hiring credit is consumed at the moment the Recruiter shortlists a candidate. This is the ONLY point at which a credit is spent: proposing, soft-locking, interviewing and releasing are all free of charge.
- Candidate Release after an Interview (0.0 Credits Consumed): There is no soft-lock activation charge and no deduction of credits where a candidate is released after the completion of at least one round of interview. Repeated releases of this kind may flag the account for review under clause 3.3 (Adherence to Timelines & Anti-Ghosting) - a consequence to standing, not to the balance.
- Candidate Release without an Interview (1.0 Credit Consumed): Where 4 candidates are released without the completion of at least one round of interview, exactly one (1.0) credit is consumed. Locking a candidate and releasing them without ever meeting them takes that candidate off the market for nothing, and the charge falls on the pattern rather than on any single release: the count starts again once it has been applied.
- There is no partial debit, processing charge or retention of any fraction of a credit at any point in an engagement. Credits are consumed in whole units, and only at the two points set out above.
- Plan Limits & Conditions: Each package carries its own limits on the number of recruiter accounts and the number of proposals that may be open at one time:

- MployD reserves the right to change plan limits at any time. Existing contracts will not be affected by the changes.
- End of Validity — Renewal or a New Subscription: When a package reaches the end of its validity the Recruiter may renew the same plan or subscribe to any other plan, with the exception of the trial package, which is available only when a company first registers. The full price of the selected plan is charged; the start date is the date the payment is approved; and the credit limit and validity period are those of the plan selected. Nothing carries forward past an expiry.
- Expiry of Credits — Upgrade: A Recruiter who has consumed their credits may upgrade at any point in the term. The price difference between the existing plan and the upgraded plan is charged; the total credit allocation is increased to the upgraded plan's limit; the available balance is re-calculated after deducting credits already consumed under the old plan; and the validity period is set to that of the new plan, running from the date of the upgrade. Where the Recruiter already holds a longer term than the new plan provides, the longer term stands — an upgrade never shortens validity already paid for.
- Non-Refundability & Credit Validity: Upfront package fees and purchased credits are non-refundable in cash once allocated, but unspent credits remain fully available for utilization across subsequent candidate discoveries within the designated package validity period.
- Invoicing & Statutory Tax Compliance: Invoices for upfront package purchases are generated immediately upon payment. All package purchases are subject to applicable Goods and Services Tax (GST) and statutory Indian tax regulations.
4. General Marketplace Rules & Limitation of Liability
- Intermediary Role: MployD acts solely as a discovery and matching platform connecting job seekers with hiring organizations. MployD is not an employer, employment agency, or labour contractor.
- No Guarantee of Placement: MployD does not guarantee employment for candidates nor does it guarantee successful hiring conversions for recruiters within every 28-day cycle.
- Jurisdiction: Any legal dispute, claim, or controversy arising out of or relating to these Terms shall be governed by and construed in accordance with the laws of India, and subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.
